On 25 August 2008 we filed suit against Shuffle Master in the Federal Court for the Southern District of
Mississippi in Jackson Mississippi. Trial by jury was demanded.
A summary of the Counts set out in our Complaint is as follows:-
- violation of Sherman Antitrust Act - unreasonable restraint of trade
- violation of Sherman Antitrust Act - monopolization of relevant markets
- violation of Sherman Antitrust Act - attempted monopolization
- violation of Clayton Antitrust Act - based on the Shuffle Master acquisition of PGIC table games
- breach of contract, failure of consideration, quasi estoppel, unclean hands
- breach of duty of good faith and fair dealing
- patent infringement
- patent misuse
- unfair and deceptive trade practices
A summary of the Relief sought in our Complaint is as follows: -
- compensatory damages of a least $15,000,000
- plus trebling of antitrust damages
- plus trebling of patent damages
- plus other appropriate damages
- plus legal costs including lawyers fees
- plus other equitable relief
We are confident in the merits of our Complaint. We expect to prevail on all Counts that are adjudicated.
