On 25 August 2008 we filed suit against Shuffle Master in the Federal Court for the Southern District of
Mississippi in Jackson Mississippi. Trial by jury was demanded.

A summary of the Counts set out in our Complaint is as follows:-

• violation of Sherman Antitrust Act - unreasonable restraint of trade
• violation of Sherman Antitrust Act - monopolization of relevant markets
• violation of Sherman Antitrust Act - attempted monopolization
• violation of Clayton Antitrust Act - based on the Shuffle Master acquisition of PGIC table games
• breach of contract, failure of consideration, quasi estoppel, unclean hands
• breach of duty of good faith and fair dealing
• patent infringement
• patent misuse
• unfair and deceptive trade practices

A summary of the Relief sought in our Complaint is as follows: -

• compensatory damages of a least $15,000,000
• plus trebling of antitrust damages
• plus trebling of patent damages
• plus other appropriate damages
• plus legal costs including lawyers fees
• plus other equitable relief

We are confident in the merits of our Complaint. We expect to prevail on all Counts that are adjudicated.
